1. Welcome & Agreement
Welcome to PriceTrack. These Terms of Service ("Terms") govern your access to and use of the PriceTrack website (https://pricetrack.dev), our REST API, and related services.
By registering for an account, accessing our API, or otherwise using PriceTrack, you agree to be bound by these Terms. If you are using our service on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so. If you do not agree with these Terms, you may not use our service.
2. About Our Service
PriceTrack maintains a catalogue of approximately 35,000 software products. We compile this data by automatically monitoring publicly published pricing pages. We record plan and price changes so that businesses and developers can view historical trends, compare competitors, and receive alerts when a price changes.
Important notice regarding data accuracy. The pricing data we provide is gathered automatically from third-party websites. Because vendors frequently change their layouts, pricing structures, and terms, our data may be incomplete, delayed, or inaccurate. All information provided by PriceTrack is for informational purposes only. It does not constitute an offer, a quotation, or professional advice. You must independently verify all pricing and terms directly with the software vendor before relying on it or making any purchasing decisions.
3. Your Account
To use certain features of PriceTrack, you must register for an account. We use WorkOS to manage authentication, and you may sign in using Google or GitHub OAuth.
You are responsible for maintaining the security of your account credentials and API keys. You agree to provide accurate and complete information when creating your account and to keep this information up to date. You may not share your account credentials or API keys with individuals outside your organization. If you suspect any unauthorized use of your account, you must notify us immediately at support@pricetrack.dev. You may terminate your account at any time through your account settings.
4. Acceptable Use
We want you to get the most out of PriceTrack, but we must protect our infrastructure and intellectual property.
API usage and limits. API access is governed by rate limits enforced per API key based on your subscription tier:
- Pro tier: 10,000 requests per day.
- Advanced tier: Unlimited requests, subject to reasonable fair use to prevent infrastructure abuse.
Prohibited conduct. When using PriceTrack, you agree that you will not:
- Resell, redistribute, or sublicense our pricing data or API access to third parties.
- Bulk-export or scrape the PriceTrack catalogue.
- Use our API or web application to reconstruct, build, or populate a competing database or product.
- Attempt to bypass our rate limits or security measures.
- Use the service for any illegal purpose or in violation of any applicable laws.
Violation of these rules may result in immediate suspension or termination of your account and API access without a refund.
5. Content & Intellectual Property
Our property. PriceTrack owns all rights, title, and interest in the PriceTrack platform, API, underlying software, and the aggregated, structured database of pricing information we have compiled. We grant you a limited, non-exclusive, non-transferable license to access and use the service strictly in accordance with these Terms.
Your property. You retain all rights to your specific account data, configurations, and the lists of products you choose to track. You grant us a limited license to host, process, and display this data solely as necessary to provide the service to you.
6. Payments & Billing
We partner with Paddle, which acts as our Merchant of Record. When you purchase a subscription, your payment is processed directly by Paddle, and their checkout terms also apply to your purchase.
Pricing tiers:

- Pro: $29/month or $290/year
- Advanced: $199/month or $1,990/year
- Daily Digest add-on: $9/month
Free trials and billing. Paid tiers include a 7-day free trial. If you do not cancel before the end of the 7-day period, Paddle will charge your payment method for the selected subscription. Subscriptions automatically renew at the end of each billing cycle unless cancelled.
Cancellations and refunds. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing cycle. Every paid subscription is covered by a 30-day money-back guarantee — see our Refund Policy.
7. Privacy
Our data processing practices are governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. We do not sell or share your personal information with third parties for their own marketing purposes.
8. Disclaimers & Limitations
Service "as is". PriceTrack is provided on an "as is" and "as available" basis. While we strive for high reliability, we do not guarantee that the service will be uninterrupted, error-free, or completely secure.
Limitation of liability. To the maximum extent permitted by law, PriceTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the service or reliance on our pricing data. Our total liability to you for any claims arising out of these Terms or your use of PriceTrack shall not exceed the total amount you paid to us in the twelve months immediately preceding the event giving rise to the claim.
9. Dispute Resolution
Informal resolution. If you have an issue with PriceTrack, we want to fix it. Before filing a formal legal claim, you agree to try resolving the dispute informally by contacting us at support@pricetrack.dev. We will try to resolve the issue within 30 days.
Binding arbitration. If we cannot resolve the dispute informally, any remaining dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Class action waiver. You and PriceTrack agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
10. Changes & Termination
Changes to terms. We may modify these Terms from time to time to reflect changes in our business or legal requirements. If we make material changes, we will notify you via the email address associated with your account or through a prominent notice on our platform. Your continued use of the service after the effective date of the changes constitutes your acceptance of the updated Terms.
Termination. We reserve the right to suspend or terminate your access to PriceTrack if you violate these Terms, abuse our API, or fail to pay your subscription fees.
11. General Legal
Governing law. These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Subject to the dispute resolution provisions in Section 9, the state and federal courts located in Delaware have exclusive jurisdiction. Nothing in this clause removes any mandatory protection you have as a consumer under the law of your own country of residence.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire agreement. These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PriceTrack regarding PriceTrack.

13. Confidentiality
Both parties agree to protect each other's non-public, confidential information with the same degree of care they use to protect their own confidential information, but in no event less than a reasonable degree of care. This obligation does not apply to information that is already public, independently developed without use of the confidential information, rightfully obtained from a third party, or required to be disclosed by law.
14. Indemnification
By you. You agree to indemnify and hold harmless PriceTrack from any claims, damages, or expenses arising from your misuse of the service, your violation of these Terms, or any content you upload to our platform.
By us. PriceTrack agrees to indemnify and hold you harmless against any third-party claims alleging that your use of the PriceTrack platform, excluding the third-party pricing data itself, infringes upon their intellectual property rights.
15. Service Levels
We use managed infrastructure to keep PriceTrack running smoothly. However, we do not currently offer a formal Service Level Agreement or guaranteed uptime commitment. The service is provided without guaranteed service credits for downtime.
16. Force Majeure
Neither party will be liable for any failure or delay in performance under these Terms, other than for delay in the payment of money due and payable, to the extent such failures or delays are caused by events beyond their reasonable control, including acts of God, natural disasters, terrorism, riots, or widespread internet or telecommunications failures.
17. Beta and Preview Features
From time to time, we may offer features labeled as "beta," "preview," or "experimental." These features are provided "as is" for testing purposes, may contain bugs, and are excluded from any standard support or security commitments. We may change or withdraw beta features at any time without notice.
18. Order of Precedence
If you are an enterprise customer and have executed a separate Master Services Agreement, Order Form, or Data Processing Agreement with PriceTrack, the terms of those documents will control in the event of a conflict with these Terms, in the following order of precedence: Order Form, MSA, DPA, and then these Terms of Service.
19. Arbitration Opt-Out
You have the right to opt out of the binding arbitration and class action waiver provisions described in Section 9. To do so, you must send written notice of your decision to support@pricetrack.dev within thirty days of creating your account. If the class-action waiver is found to be unenforceable by a court of competent jurisdiction, then the entirety of the arbitration agreement shall be null and void as to that specific claim.
20. Data Export and Deletion on Termination
Upon termination or cancellation of your account, you will have a thirty-day window to export your account data, such as your tracked product lists and account settings, in a standard, machine-readable format. After this 30-day export window expires, your account data will be permanently and irreversibly deleted from our active databases.
21. AI Content and Training
We use artificial intelligence models (specifically OpenAI and Anthropic) exclusively to extract and structure pricing data from the publicly available third-party web pages we scrape.
No training on customer data. We grant AI providers access only to the public web pages we scan. We do not, and will never, use your customer content, account data, or usage metrics to train our own or any third-party AI models. The license you grant us to process your data is strictly limited to operating, securing, and supporting the PriceTrack service for you.
AI output disclaimer. Because our pricing catalogue is generated in part by AI extraction from third-party sites, the output may occasionally contain errors or inaccuracies. You are solely responsible for reviewing and verifying any pricing data obtained through PriceTrack before relying upon it.
